A family-based petition is a process through which a United States Citizen or a Lawful Permanent Resident (Green Card Holder) can sponsor certain relatives to come and live in the U.S. as lawful permanent residents. The U.S. immigration laws provide opportunities for family members to reunite with their U.S. citizen or lawful permanent resident family members.

The family-based immigration system is divided into two main categories:

The process for family-based immigration typically involves the U.S. citizen or lawful permanent resident family member filing a Form I-130, Petition for Alien Relative, on behalf of their qualifying family member. Once the petition is approved, the foreign national family member may apply for an immigrant visa (if outside the U.S.) or adjustment of status (if already in the U.S legally) to become a lawful permanent resident.
